Who must be entered in the register
Employment agency services and temporary work are regulated activities in Poland. A company that provides them must be entered in the register of employment agencies (rejestr agencji zatrudnienia) (Art. 305(2) of the Act on the Labour Market and Employment Services). The register is maintained by the Marshal of the Voivodeship (marszałek województwa), and its data is public (Art. 308(1) and (2)).
An entry is not a quality certificate. To be entered, the company may not have tax or ZUS arrears, and the people managing it may not have been convicted of, among others, offences against employees’ rights. It must also have office premises (Art. 305(7) and Art. 307). The authority may check this before the entry (Art. 311). The register does not show how an agency treats people.
Without an entry, only entities listed in the Act may find jobs for people. These include, among others, local government units, academic career offices, and foundations and associations that do not conduct business activity (Art. 306(1)). A company that earns money by finding workers or employs them for temporary work must have an entry.
How to check an entry step by step
- Open the register search engine on stor.praca.gov.pl.
- Enter the entry number if the agency provides it. If it does not, search by name or NIP.
- Open the entry details and compare the data with the contract you are going to sign.
An entry does not expire over time, but every year by 31 January the agency submits information to the Marshal about its activity in the previous year (Art. 323(1)). If it does not conduct activities covered by the entry for 2 consecutive years, the Marshal removes it from the register (Art. 315(1)(3)). An old entry date is therefore not proof that the company operates today: check the status.
A number in the website footer or in an advertisement is not enough. A number can be copied from someone else’s entry, so what matters is that the name, NIP and address match the company that signs the contract with you.

Employment agency services and temporary work are two different contracts
With employment agency services, the agency finds you a job, and you sign the contract with the company where you work. With temporary work, the agency is your employer, and you work for another company under its supervision (Art. 305(2)). The register shows which of these services the agency is entered for.

Foreigners: a separate entry in the register
An agency may refer foreigners who need a work permit or a declaration on entrusting work to a job only after 2 years from its entry in the register, during which it provided job placement or temporary work services. It must also obtain an amendment to its entry (Art. 305(3) and (4)). In the search engine, this service has a separate line referring to Art. 305(3).
When referring a foreigner to work in Poland, the agency concludes a written contract with them. The contract specifies the company where the work will be performed, the period of work, the type of contract, remuneration and insurance (Art. 337(2) and (3)). Before signing, the agency gives you a written translation of the contract into a language you understand (Art. 337(4)).
The agency also informs you in writing, in an understandable language, about the rules for entering, staying and working in Poland as a foreigner (Art. 337(5)). If you did not receive a translation of the contract, ask for it before signing.
An agency may refer a foreigner only directly to the company where they will work (Art. 337(1)). An intermediary who passes people on to another intermediary operates outside this provision. An agency that employs foreigners through temporary work without a valid residence document loses its entry (Art. 315(1)(8)).
What the agency cannot charge you for
An agency may not charge people for whom it is looking for work any amounts other than those listed in the Act (Art. 321(1)(1)). The Act lists four such costs, actually incurred, all related to going abroad for work. They are travel there and back, a visa, medical examinations and document translation (Art. 338(3)(16)).
For work in Poland, a candidate therefore pays the agency nothing. A fee for registration, reserving a place or preparing a CV has no basis in the Act. For violating this prohibition, the Marshal of the Voivodeship removes the agency from the register (Art. 315(1)(4)).
An agency also may not reject a candidate because of sex, age, nationality, religion or disability (Art. 319).

Questions
Is it enough for an agency to have a KRAZ number in the website footer?
No. Enter the number in the search engine at stor.praca.gov.pl and check whether the name, NIP and status match the company with which you are signing the contract.
Can an agency from another voivodeship look for a job for me in Warsaw?
The entry is made by the Marshal of the Voivodeship where the agency has its registered office (Art. 308(3)). The search engine at stor.praca.gov.pl covers agencies from the whole country, so you can check the entry in the same way.
What should I do if the agency is not in the register?
Do not sign the contract or pay. Without an entry, a company cannot provide employment agency services or temporary work (Art. 305(2)). Also search by NIP, because the name in an advertisement may differ from the name in the register.
The agency wants money for medical examinations before work in Poland. Can it do that?
No. Medical examinations are on the list of permitted costs only when referring someone to work abroad (Art. 338(3)(16)). For work in Poland, the agency does not charge the candidate any amounts (Art. 321(1)(1)).
