Work permits for foreign staff

You have found the person and want to employ them lawfully. That part is ours: the right document for their situation, filing through praca.gov.pl on your behalf, and tracking the deadlines the office holds you to.

The deadlines where companies lose money

What we track for you

For a declaration entered in the register (art. 68 and 70 of the Act of 20 March 2025 on the conditions for entrusting work to foreigners):

  • Work started: 7 days from the start
  • Work not started: 14 days from the date in the declaration
  • Work ended earlier than stated in the declaration: the Act sets no deadline, we report it at once
  • A copy of the contract in Polish, sent electronically before work begins
  • Copies of residence documents kept for 2 years from the end of the year in which the contract ended (art. 4 ust. 4 and 6)

Under a single permit both sides report a lost job to the voivode: the company within 15 days, the worker within 15 working days (art. 121 of the Act on Foreigners). We remind the worker of this when the job ends.

What a missed date costs

  • Fine for unlawful employment: from 3,000 to 50,000 zł
  • At least 3,000 zł per foreign worker
  • For offences under art. 84 of the Act on entrusting work to foreigners, the labour inspectorate or the Border Guard may issue a fixed penalty of up to 10,000 zł; a higher fine is for a court
  • A late notice that work has or has not started: from 500 to 5,000 zł
  • Inspections are run by the Labour Inspectorate and the Border Guard

A missed notice deadline when the worker's situation changes is enough for a fine. That is why we keep a calendar for the whole team and write before the date passes.

What changed in recent months

June 2025Applications and declarations only through praca.gov.pl. The labour market test was abolished and notices about work starting and not starting were added.
December 2025Georgia dropped off the list: declarations now cover Armenia, Belarus, Moldova and Ukraine only.
April 2026Residence cases moved to MOS, the online portal of the Office for Foreigners. Work applications stayed on praca.gov.pl: two different systems and two different accounts.
What it changesDocuments from before the changes are often out of date, and templates found online even more so. We check the rules as they stand on the day of filing, not on the day someone wrote a guide.

When no permit is needed

Before we start on documents we check whether they are needed at all. Sometimes they are not, and we say so at once.

Citizens of the European UnionThey work on the same terms as Polish citizens. No permit and no declaration are required.
Permanent residence and EU long-term residentA permanent residence permit or EU long-term resident status removes the work permit requirement.
Ukrainian citizens with UKR statusThey work without a permit. The office must be notified within 7 days of the start, or the company faces a fine of 1,000 to 3,000 zł. We send the notice for the company.
Spouse of a Polish citizenWhere temporary residence was granted on the basis of marriage to a Polish citizen, no work permit is required.
Graduates of Polish schoolsAnyone who finished a Polish secondary school or full-time studies in Poland works without a permit.
Karta PolakaA holder of a valid Karta Polaka works without a permit. It is a separate ground, independent of a residence card.

What employers ask

Can you file on our behalf?

Yes. Work applications go through praca.gov.pl and a power of attorney works there: we sign and send the documents for the company. Residence cases are different: the worker signs from their own MOS account and nobody can do it for them.

The worker already holds a residence card. Is a work permit still needed?

It depends on the card. Some cards remove the permit requirement, others allow work only for a named employer on named terms. We check the document itself, not what the worker remembers.

How long does a declaration take?

The law gives the office 7 working days from receiving the declaration, and up to 30 days where it opens an inquiry. We do not promise an exact date: that side is the office's, not ours. Our part takes one working day.

The post or the rate is changing. Do we need to act?

Usually yes: the terms of work must match the document. A pay rise often needs nothing, a change of post or hours often does. Write before the change rather than after, and it can be arranged with no break in lawful work.

What does your work cost?

It depends on the number of workers and the type of document. One person is one case; fifteen is a calendar of dates for the year. We give the price after a conversation and do not add sums along the way. The state fee for a declaration or permit is paid separately by the company that employs the worker.
